Someone asked a question recently on if you have sex with a woman who is drunk and passes out is it illegal. Of course that is rape because she had to give consent….but it got me to thinking about another similar situation that to be honest I don’t know the answer to. In the previous question it was kindof implied you were with a stranger or at least thats my take on it BUT what if it’s your wife? Man and woman are married and have too much to drink one night. She passes out and he makes out with her.
Not saying I think it’s ok, let me make that clear, just that I am not sure what the legal implications of that is if she woke up the next morning and learning she had been “had” by him decided to press rape charges, which legally I guess it would be. Anyone have any idea on what the law says on this? Any juridiction.
