February 2007: Wasn’t speeding or anything wrong, I was pulled over for a busted tailight, then ticketed for driving passenger without six months of driving time.

August 2007: Ticketed for going 50 in a 40 mph zone.

Question: How long can my license be suspended for these offenses?

I was in a car accident in Indiana several years ago. The police came to the hospital 5 hours after the accident and read me the implied consent law and asked for my consent for the hospital to draw my blood. Not being coherent (head trauma) or knowing of the 3 hour limitation in the implied consent law my girlfriend granted consent. After all the Police officer was threatening to suspend my license for a year if I did not consent. It has now been determined by the courts that the blood draw is inadmissible because the implied consent laws in Indiana require the blood to be drawn within 3 hours of the accident.

Here is the real question. Is the hospital liable? What is required for them to hand over my blood? If they were given an affidavit from the police officer then it was falsified, so I want to know what recourse I have and who is ultimately responsible for violating my civil rights?
